
Terms and Conditions of Usage of Online Journals
These Terms and Conditions of Usage refer to the following Earthscan online journals:
Advances in Building Energy Research
Architectural Engineering and Design Management
Climate Policy
International Journal of Agricultural Sustainability
(hereinafter called the “Journal”)
Access to papers is restricted to institutions or individuals with a current subscription to the Journal.
Use of the online Journal is governed by the following terms and conditions.
1. Copyright
The International Institute for Conservation of Historic and Artistic Works (IIC) owns the copyright of Studies in Conservation. Earthscan owns the copyright of all other journals, unless otherwise noted in individual articles.
Earthscan, an imprint of James & James (Science Publishers) Ltd, (hereinafter called the Publisher) warrants that it has the authority to make available the Journal and that it has secured all rights and permissions necessary to enable authorized users to utilize such materials in compliance with this licence.
2. The Licence
Subject to the terms and conditions of this agreement and upon payment of the annual subscription fee, the Publisher grants to the Institution/personal subscriber a one-year, non-transferable licence for access to all materials included in the online version of the Journal.
3. Terms of access
This licence will cover access, during the calendar year for which a subscription has been paid, to the full database of the Journal, including: tables of contents, abstracts, full text and graphics of all articles, including multi-media adjuncts where appropriate, in the current year and to any previous years, where available.
Access to the current year of the Journal shall be controlled through the use of Internet Protocol (IP) addresses. Institutional subscribers are responsible for ensuring that the Publisher has been supplied with a valid IP address (a registration form is provided for this purpose). Valid IP addresses cannot include publicly accessible proxy or cache servers.
This will permit an authorized user from an authorized IP address to have access to the current year of the Journal.
Institutional subscribers should notify the Publisher within 30 days of any changes in registration data or IP addresses.
4. Definitions
For the purposes of this licence, an institution is defined as: a one contiguous campus community and network, including any halls of residence of faculty, staff or students; or, in the commercial sector, one contiguous commercial office complex.
Authorized Users include current members of the faculty and other staff of the Licensee (whether on a permanent, temporary, contract or visiting basis) and individuals who are currently studying at the Licensee's institution, who are permitted to access the Secure Network from within the Library Premises or from such other places where Authorized Users work or study (including but not limited to Authorized Users' offices and homes, halls of residence and student dormitories) and who have been issued by the Licensee with a password or other authentication [together with other persons who are permitted to use the Licensee's library or information service and access the Secure Network but only from computer terminals within the Library Premises].
5. Multi-site or consortium access
Extended licences for multi-site institutions and consortia are available; please contact the Journals Manager: journals@earthscan.co.uk for further information.
6. Use of the journal: what authorized users are allowed to do
Any authorized user may: search, retrieve, save and download copies of individual articles or other items from the database of the Journal for their scholarly, educational, research or personal use.
Authorized users may only transmit articles or other items from the database to other authorized users.
Authorized users may print out no more than one copy of any individual article or other item from the database of the Journal. Permission to make further hard copies of any material from the Journal must be obtained from Earthscan: rights@earthscan.co.uk. All such copies must bear the following notice: the [title of Journal], (year of publication), published by Earthscan, London, UK.
7. Interlibrary loan
The institution may supply to an authorised user of another library by post, fax or ARIEL, whereby the electronic file is deleted immediately after printing, a single paper copy of an electronic document, for the purposes of research or private study.
8. Usage restrictions: what authorized users are NOT allowed to do
i. Downloading of entire issues of the Journal is not allowed.
ii. Items from the database may not be copied or distributed for commercial advantage or if any fees or charges are made in connection with such items.
iii. Material from the Journal may not be translated, altered, re-compiled, manipulated or used to prepare derivative works, or published in any other format in any medium without written permission from the Publisher.
iv. The authors’ names or publisher’s copyright notices or other means of identification must not be removed from or altered as they appear in the Journal.
v. Items from the database may not be mounted or distributed on any electronic network, including without limitation the Internet and the World Wide Web.
vi. The Licensee may not incorporate all or any part of the Licensed Materials in Course Packs and Electronic Reserve collections without the prior written permission of the Publisher, which may set out further terms and conditions for such usage. Permission to make further hard copies of any material from the Journal must be obtained from Earthscan: rights@earthscan.co.uk.
The Publisher reserves the right to terminate the access of any authorized user in breach of the above restrictions.
9. Unauthorized usage
An institution will not be held liable to the Publisher for unauthorized use of the Journal provided that: such use is without the express or implied consent of the institution; and, in addition, that the institution shall promptly notify the Publisher of any known infringements of copyright, or any other such unauthorized activity, of which it becomes aware.
In addition, institutional subscribers shall take all reasonable steps to prevent or to cease such activity and to prevent any recurrence thereof.
10. Disclaimers
There is no guarantee that the information contained in the online version of the Journal is identical to the print version of the Journal.
The Publisher does not warrant the accuracy or completeness of any information contained in the online version of the Journal, or its merchantability or fitness for a particular purpose.
The Publisher will have no liability to any person for any loss or damage arising out of use of, or inability to use, the online version of the Journal.
The Publisher shall make all reasonable endeavours to make its server available to an institution on a 24-h basis, with the exception of normal server administration and down time.
If access is suspended or interrupted, owing to circumstances beyond the Publisher’s control, liability shall be limited to restoring access as soon as is practicable.
The Publisher reserves the right to modify the terms of this agreement immediately by providing notice online and directly to institutions by electronic and conventional mail. Continued use of the online Journal for more than 30 days after such notice shall constitute acceptance of such modification.
11. Termination of the licence
The Publisher may terminate this licence for the electronic version of the Journal, for any breach of this agreement, by providing the institution with written notice in paper or electronic form. No refund will be provided upon such termination.
12. Term of the agreement
This agreement shall continue until the later of 31 December in any particular year or 30 days after publication of the last issue of the year for which an institutional subscription is held.
